What are the benefits of post-nuptial agreements?

Texan couples who choose to divorce will usually face difficult financial hurdles. One way to make it easier is to have written a pre-nuptial agreement before the divorce. However, if you didn't do that, there are still options available. Post-nuptial agreements exist for exactly this reason, and they can be just as helpful.

ABC News states that there are many reasons to go for a post-nuptial agreement. If this is your second or third marriage, you could be considering your children from previous marriages when you divide assets up. You may also want the fairest way to decide child support payments, alimony, and divisions of other assets. A post-nuptial agreement will allow you to do that, having all of your decisions down in legally binding writing.

Additionally, a post-nuptial agreement can be signed even if your divorce hasn't happened yet. Some people create these agreements if a traumatic or upsetting event has caused either party to question the longevity of their relationship. Even if there is intent to mend the relationship or make the marriage work, a post-nuptial agreement will allow you to have a safety net to fall back on. Post-nuptial agreements written when not in the heat of divorce are generally fairer to both parties and allow more amenable terms to be made.
