How much child support willl I need to pay?

One of the most difficult and confusing aspects of divorce in Texas is the care that will be given to your children after you and your ex-spouse have separated. If you have been named the noncustodial parent, you likely have many questions. One of the first of these will concern how much child support you will be required to pay. The Texas Attorney General's office has made this answer more clear and offered details that you may need to know.

In Texas, the amount of child support you need to pay will be determined by how many children you have and will always be a percentage of your net income. If you and your ex-spouse only share one child, you will be required to pay 20 percent of your net income for support. If you have two children, that number will increase to 25 percent. The amount that you are required to pay continue to rise by five percent for each child, so 30 percent for three children, 35 percent for four children and 40 percent for five children. After five children, the amount you are required to pay will remain at 40 percent.

While these are the general guidelines, your individual situation can change the final amount. It is important that you tell the judge about any other children you are supporting, no matter which household they live in.

If any changes occur in your family, such as one or more children coming to live with you instead of with the custodial parent, you need to let the court know and request a change of status as soon as possible.
