According to the Texas Office of the Attorney General, the word paternity is used to designate the legal father of a child. In marriage, this is automatically presumed, but in cases where the parents of a child have not wed, paternity must be established through another process.


If the mother of your children is cooperative, you can both sign an Acknowledgement of Paternity and state that you are the biological father. If she is not willing to do this, you may need to seek legal help to officially determine whether or not you are eligible for paternity.


In most cases, you will need to complete a DNA test to prove that you are the biological father of the child. If you do not believe that you are the biological parent but have raised the child and feel entitled to shared custody, you will likely need to seek the approval of a judge.
