Child Support Modifications
Do you feel that you are paying too much child support? If so, I can perform a child support calculation on your behalf using the Texas child support guidelines. I can also determine if special circumstances exist in your case that may warrant a downward deviation from guideline support. I can also help if your spouse pays child support and you feel you are not receiving a sufficient amount of support.
To obtain a child support modification, you must prove that a material and substantial change of circumstances has occurred since your last child support order, or since it was last modified. If your child support order was entered three years ago or more, you may obtain a child support modification if an application of the guidelines would alter your child support obligation or award by at least 20 percent or $100 [Texas Family Code Section 156.401].
Child Custody and Visitation Modifications
I have helped many fathers obtain visitation and custody modifications. Given my experience in such cases, I can quickly identify if you may have a valid basis to pursue a modification, or if it may not be wise to pursue a modification at this time. When you visit my office for your consultation, I will give you a candid assessment of your case so you can make an informed decision about how to best proceed.
There are a number of situations where it may be necessary to seek a custody or visitation modification for the welfare of your children. Contact me if you feel concerned about the safety or emotional welfare of your children, if you have a teenage child who has expressed a preference to live with you, if your former spouse is planning to move to a new location with your children, if your former spouse has routinely denied you access to your children in violation of a court order, or if other factors exist that necessitate a modification of an existing court order.
Spousal Support Modifications
Courts may modify spousal support upon a showing of a material and substantial change of circumstances of either party. If you have been laid off from your job, if your wife's economic means have improved substantially or if other factors have changed substantially since the time that you were ordered to pay spousal support, contact me to determine if you may have a basis to pursue a spousal support modification.
