Types of Defamation Litigation
Defamation of character comes in two common forms:
- Slander
- Libel
Slander refers to defamation through the spoken word. Libel refers to defamation through the printed word. There are critical distinctions in terms of how each type of defamation is handled.
The First Amendment and Defamation Litigation
Media outlets will often stand behind the first amendment in defamation cases. However, this is not the only protection they have at their disposal. There are a variety of other statutory defenses they can use to shield themselves from defamation claims. It takes an experienced lawyer well-versed in both constitutional and statutory law to effectively navigate this complex area.
