Resolving Contract Disputes
The majority of business litigation is the result of some sort of contract dispute. They type of contract involved can vary dramatically. They can include:
- Covenants not to compete/non-compete agreements
- Trade secrets
- Sales contracts and exclusivity clauses
- Commercial lease agreements
Since 1991, I have helped businesses in all types of contract disputes. I am willing to pursue all phases of litigation, including trial, to obtain an outcome that meets the needs of my clients. I do not back down from courtroom battles when they are required to get results.
The Case Is in the Contract
Contract disputes frequently turn into he said/she said arguments. These arguments do not go very far in terms of resolving these disputes. As far as the law is concerned, these cases usually are limited to the contract itself. These cases hinge on contract interpretation. They hinge on applying current laws to the language used in the contract. In these instances, very little, if any, outside evidence can be brought into these cases.
When I begin a contract dispute case, I start by working with my client to get to know their side of the story. I get to know the outcome that they would like to obtain. I thoroughly review the contract and offer guidance about how to move forward. Whenever possible, I strive to resolve disputes even prior to the filing of a lawsuit. Of course, this is not always possible. Sometimes they must go to trial. This is a possibility that I am always prepared for.
